Tutor Terms and Conditions

1. Introduction

Welcome to Brain Boosters. These Terms and Conditions (“Terms”) govern your access to and use of the Brain Boosters website, mobile application, courses, webinars, training programmes, learning materials, assessments, certificates, and related services (collectively, the “Services”).

By accessing, registering for, or using any of our Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, you should not use the Services.

2. Definitions

  • “Brain Boosters”, “we”, “us”, and “our” refer to the Brain Boosters platform and its authorised representatives.
  • “User” means any learner, student, participant, visitor, trainer, mentor, educator, or other person using the Services.
  • “Partner” means an educational institution, training organization, trainer, mentor, agency, or other entity collaborating with Brain Boosters.
  • “Content” includes courses, videos, presentations, documents, study materials, assessments, quizzes, recordings, certificates, and other learning resources.

3. Scope of Services and Collaboration

Brain Boosters may independently or jointly with its partners provide educational, training, and skill-development opportunities. Depending on the applicable programme or collaboration, activities may include:

  • Course development and training delivery;
  • Workshops, webinars, masterclasses, and educational events;
  • Student enrolment, outreach, and programme promotion;
  • Learning resources, study materials, assessments, and academic support;
  • Certification and completion verification;
  • Internship, placement, career guidance, and employability initiatives; and
  • Any other educational activity mutually agreed upon in writing.

The specific scope, deliverables, timelines, commercial terms, and responsibilities for a particular programme or partnership may be governed by a separate written agreement. Where a separate agreement applies, it will govern that specific arrangement to the extent of any inconsistency.

4. User Registration and Account Responsibilities

  • Users must provide accurate, complete, and current information during registration.
  • Users are responsible for maintaining the confidentiality of their account credentials and for activities carried out through their accounts.
  • Users must promptly notify Brain Boosters of any suspected unauthorised access or misuse.
  • Brain Boosters may suspend, restrict, or terminate an account where information is false, misleading, incomplete, or used in violation of these Terms.

5. Roles and Responsibilities

5.1 Brain Boosters Responsibilities

  • Provide the applicable training programmes, learning resources, and reasonable technical or programme support.
  • Coordinate course delivery, enrolment processes, assessments, and certification, where applicable.
  • Support approved marketing and promotional activities for programmes.
  • Maintain reasonable standards of professional conduct and service delivery

5.2 Partner Responsibilities

  • Promote approved programmes accurately to the intended audience.
  • Provide qualified trainers, mentors, subject-matter experts, or other agreed support.
  • Share required information within agreed timelines and maintain the confidentiality of non-public information.
  • Obtain any required permissions, approvals, or rights for materials, personnel, or content supplied by the Partner
  • Avoid making unauthorised promises, guarantees, pricing commitments, or representations on behalf of Brain Boosters.

5.3 Joint Responsibilities

  • Work collaboratively and in good faith to achieve the agreed objectives
  • Maintain regular communication and share relevant updates in a timely manner
  • Address operational concerns promptly and professionally.
  • Protect the reputation, interests, and legitimate objectives of both parties

6. Payment and Payout

The payment amount or revenue-sharing percentage for Tutors and Coaching centres will be mutually agreed upon and confirmed by Brain Boosters before the commencement of the collaboration.

Payouts will be processed weekly based on the eligible earnings generated during the respective payment period with 20% deduction as platform fee from the payment made by the participants.

The payment will be made after verification of enrollments, course completion, or other applicable requirements.

Brain Boosters reserves the right to hold or adjust payouts in case of cancellations, refunds, incorrect information, or any payment-related discrepancies.

7. Refund Policy

Participants may request a full refund before the course or programme starts. Once the course or programme has commenced, refunds will not be applicable. Approved refunds will be processed through the original payment method within 7-10 working days. Brain Boosters reserves the right to review each refund request based on the applicable programme terms.

Course Progress Limit: Allow automatic refunds only if the learner has watched less than 20% of the content.

8. Intellectual Property

The Coaching Center may publish or distribute the same content on other platforms. However, the Coaching Center acknowledges that doing so may reduce student enrollments and revenue generated through the BrainBoosters platform, and BrainBoosters shall not be responsible for any such reduction.

9. Learning Content, Assessments, and Certification

Course outcomes may vary based on a learner's participation, effort, prior knowledge, and completion of programme requirements. Brain Boosters does not guarantee employment, placement, income, business results, examination outcomes, or any specific career outcome.

Certificates may be issued only when the applicable eligibility criteria are met. These criteria may include required attendance, completion of learning modules, assessment performance, submission of assignments, or other stated requirements. Brain Boosters may verify completion records before issuing a certificate and may withhold, correct, revoke, or reissue a certificate where there is an error, misrepresentation, academic misconduct, or violation of these Terms.

10. Acceptable Use and Professional Conduct

Users and Partners must act professionally, ethically, respectfully, and in compliance with applicable laws and platform policies. The following are prohibited:

  • Harassment, discrimination, abusive conduct, threats, or inappropriate behaviour;
  • Impersonation, false claims, misleading information, or fraudulent activity;
  • Unauthorised sharing of login credentials, participant information, or protected Content;
  • Disruption of classes, webinars, assessments, or platform operations;
  • Uploading or sharing unlawful, harmful, infringing, or inappropriate material; and
  • Any activity that may harm the safety, reputation, systems, or legitimate interests of Brain Boosters, its users, or its partners.

11. Privacy and Data Protection

Brain Boosters may collect and process information necessary to provide, administer, improve, secure, and communicate about the Services. Information may include registration details, contact information, learning progress, attendance, assessment results, certificates, support requests, and relevant platform activity.

Personal information will be handled in accordance with the applicable Privacy Policy and relevant legal requirements. Users should provide only information that is necessary for the intended service. Where information is shared with authorised trainers, partners, service providers, or institutions, it will be limited to what is reasonably required for the relevant programme or service.

12. Confidentiality

Non-public business information, programme plans, learner information, commercial terms, credentials, and other confidential information shared during a collaboration must be protected and must not be disclosed or used for an unauthorised purpose. This obligation does not apply to information that is publicly available through no breach, independently developed, lawfully obtained from another source, or required to be disclosed by law.

13. Third-Party Services and External Links

The Services may contain links to or integrations with third-party websites, platforms, payment providers, communication tools, or learning services. Brain Boosters does not control and is not responsible for third-party content, availability, security, policies, or practices. Use of third-party services is subject to their own terms and policies.

14. Availability and Changes to Services

Brain Boosters may update, modify, replace, suspend, or discontinue any part of the Services when reasonably necessary for operational, technical, educational, legal, or business reasons. We will make reasonable efforts to communicate material changes where appropriate, but uninterrupted or error-free availability cannot be guaranteed

15. Disclaimer and Limitation of Liability

The Services are provided on an “as available” basis. To the extent permitted by applicable law, Brain Boosters does not make guarantees regarding uninterrupted availability, error-free operation, suitability for every purpose, or achievement of a particular learning, employment, placement, or business outcome.

To the extent permitted by applicable law, Brain Boosters will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of, or inability to use, the Services. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

16. Suspension and Termination

Brain Boosters may suspend or terminate access to an account, programme, or collaboration where there is a breach of these Terms, misuse of the Services, non-payment of applicable fees, misconduct, infringement of intellectual property, security risk, legal requirement, or other material operational concern.

Termination does not remove obligations that by their nature should continue, including obligations relating to confidentiality, intellectual property, payment, liability, and dispute resolution.

17. Changes to These Terms

Brain Boosters may revise these Terms from time to time. The updated version will take effect on the date stated in the revised document or when otherwise communicated. Continued use of the Services after the effective date of an update constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

18. Governing Law and Dispute Resolution

These Terms will be governed by the applicable laws of India. The parties should first attempt to resolve any concern or dispute through good-faith discussion. If the matter is not resolved, it may be referred to the appropriate courts or other legally available dispute-resolution process, subject to applicable law and jurisdiction.

19. Contact and Notices

For questions, support requests, complaints, or notices relating to these Terms, users may contact Brain Boosters through the official contact details published on the platform or provided for the relevant programme.

20. General Provisions

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to the extent permitted by law.
  • A failure to enforce a provision does not constitute a waiver of that provision.
  • These Terms, together with applicable programme-specific policies and written agreements, form the relevant understanding governing use of the Services.
  • Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship unless expressly stated in a separate written agreement.

By accessing, registering for, or using Brain Boosters Services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
